Ahmadi : I am not casting aspersions. I object to being interrupted when I am submitting.This is not the manner in which I argue a case.

Ahmadi : Please see the manner in which order is passed. It is passed when the parties are there for execution of the commission. And on whose say? Not on the report of the Commission. On an application by plaintiff. Does it not show some element of lack of fairness.

J Chandrachud : Where exactly was the shiv ling found?

SG : We haven't seen the report.

SG : Wazukhana, as I understand, is the place where you wash and there is a separate place to offer namaz. The concern of Magistrate seems to be that if something significant is found, anyone entering nearby might cause some difficulty.

J Chandrachud : We will issue notice and keep a short date. In the meantime, we will issue a direction that the District Magistrate will ensure that the place where Shiv Ling is found is protected, but this will not restrict the right of Muslims to offer namaz.

J Chandrachud : This part of the order, the moment he says the application is allowed, it means that the application in its entirety is allowed...

SG : Or in the alternative, in the terms of the order.

J Chandrachud : Now see the operative order. The judge says the application is allowed. The moment he allows the application, all prayers are allowed. What he says is that the area should be sealed and entry of persons should be prohibited in the sealed area.
