Supreme Court Issues Notice To Cricketer Mohammad Shami On Wife's Plea To Enhance Monthly Maintenance

The Supreme Court on Friday issued notice to Indian cricketer Mohammad Shami on a petition filed by his wife seeking enhancement of maintenance ordered for herself and their daughter.The wife has challenged the Calcutta High Court's orders dated July 1, 2025 and August 25, 2025, which enhanced her interim maintenance to ₹1.5 lakh per month and ₹2.5 lakh for their minor daughter. Contending that the amount is grossly inadequate considering Shami's financial status and lifestyle, Jahan has sought an increase of maintenance to ₹7 lakh per month for herself and ₹3 lakh per month for their daughter.A bench comprising Justice Manoj Misra and Justice Ujjal Bhuyan issued notice to Shami and the State of West Bengal on the petition.The Special Leave Petition filed under Article 136 also questions the payment schedule directed by the High Court, which allowed the cricketer to clear arrears in eight monthly instalments.The petition highlights that while Shami's annual income as per his income tax return for 2021–22 was nearly ₹48 crore, she has been compelled to live in “down-trodden conditions,” struggling to afford basic necessities.It is claimed that Shami owns luxury vehicles including a Range Rover, Jaguar, Mercedes, and Fortuner.The cricketer married in April 2014, and the couple has a daughter. In 2018, the wife lodged an FIR at Jadavpur Police Station alleging domestic violence, leading to a chargesheet against him. She later approached the court under the Domestic Violence Act seeking interim maintenance. The trial court granted ₹80,000 per month for the child but denied her any maintenance. On appeal, the Sessions Court in 2023 awarded ₹50,000 for the wife and ₹80,000 for the daughter. The Calcutta High Court on July 1, 2025, enhanced the amounts to ₹1.5 lakh and ₹2.5 lakh respectively, and by order dated August 25, 2025, permitted payment of arrears in eight monthly instalments.Senior Advocate Shobha Gupta appeared for the petitioner.
