Supreme Court Orders Medical Stipend To Foreign Medical Graduates At Par With Indian Graduates

The Supreme Court recently ordered that foreign medical graduates are liable to get a stipend at par with Indian medical graduates. This order was passed by a bench comprising Justice Aravind Kumar and Justice PB Varale, who were dealing with a writ petition filed by Indian citizens who have obtained foreign medical education from Kazakhstan, the Philippines, Russia and China. They have completed their internship in Rajendra Institute of Medical Sciences in Jharkhand for the period June 2023 to June 2024.The petitioners are seeking a monthly stipend for one year of internship at par with their juniors, who were students that completed their medical education from Ukraine and Kazakhstan and were granted a stipend at par with Indian medical graduates pursuant to the Court's July 15, 2025, order at the rate of Rs. 26,300/month. In July 15 order, AMU had raised the issue that, before dispersing the stipend, permission from the University Grants Commission(UGC) is required. The Court had ordered the stipend to be paid and for the UGC not to take any adverse steps merely because prior permission was not sought.After considering the plea and perusing its July order, the bench noted that the petitioners stand on the same footing as their junior. Therefore, they can't discriminate and pay less stipend than their juniors. Disposing of the matter, the Court ordered the stipend to be paid within 2 weeks.
