The Supreme Court today(September 30) criticised the Uttar Pradesh police for registering a first information report against an unknown person in a case relating to harassment, despite the fact that the complainant had apprehended the suspect on the spot.

In a case before Justice Sanjay Kumar and Justice Sanjeev Sachdeva, the complainant appeared in person and alleged that despite her informing the UP Police about the alleged local politicians who trespassed into her private property and harassed her and her family members, the police registered an FIR under Sections 452, 323, 354, 504, and 506 of the Indian Penal Code against unknown persons.

Therefore, they moved the Trial Court, which granted them anticipatory bail. The petitioner mentioned that she moved for cancellation before the High Court, which refused to cancel the bail granted to the two accused persons. Against this order, she preferred the present plea.

When the matter came up here, the Court had asked the UP Police to file an affidavit in this regard, which was filed by Shobit Kumar, Circle, Khurja, Bulandshahr, UP. However, the Court found the affidavit to be "utterly uninspiring" because it clearly revealed that the FIR was supplemented with the accused's name later as while the name was omitted in the FIR, it was disclosed in the affidavit of the police.

Questioning how an investigating agency could break the trust of the people, Justice Kumar asked the Circle Officer to be present in the next hearing.

"We find the affidavit dated 25.09.2026 filed by Mr. Shobhit Kumar, Circle Officer, Khurja, Bulandshahr, Uttar Pradesh, to be utterly uninspiring. The said officer shall be present before this Court on the next date of hearing to account for the same. It would be open to him to file a better affidavit explaining as to why First Information Report No. 195/2026 was registered on 19.08.2026 against an unknown motorcycle rider when it is the admitted fact that the said motorcycle rider was apprehended at the spot. In paragraph 6 of the aforestated affidavit, the name of the motorcycle rider is disclosed as Tushar s/o Sh. Prempal. The reason as to why the name was left blank in the FIR initially and was, thereafter, supplemented, requires to be explained."
