Supreme Court Refuses To Entertain Petition Seeking Contempt Action Against BJP MP Nishikant Dubey For Comments Against CJI Sanjiv Khanna

The Supreme Court on Monday (May 5) refused to entertain a petition seeking contempt action against BJP MP Nishikant Dubey for his comments attacking the Chief Justice of India.The bench of CJI Sanjiv Khanna and Justice Sanjay Kumar was hearing a writ petition filed by Advocate Vishal Tiwari, seeking to initiate criminal contempt against Dubey. At the same time, the bench said that it will pass an order expressing its views.The bench, refusing to allow a hearing on the matter, said, " We will pass a short order. But we will not entertain it ....we will be expressing our views." Tiwari argued that the statements were not only scandalising but also hateful and provocative. He stressed the need for action against Dubey. Previously, the bench led by Justice Gavai agreed to consider another plea seeking directions to remove social media posts/videos doing the rounds on the internet since Dubey's remarks. Notably, an Advocate on Record has also written to the Advocate General R Venkataramani urging the sanction for initiating contempt proceedings against Dubey. In the wake of Dubey's remarks, the Supreme Court Advocates-on-Record Association (SCAORA) also passed a resolution expressing its deep dismay and unequivocal condemnation of the statements made against the CJI and the Judiciary. In a news interview, Dubey had made statements against CJI Sanjiv Khanna, especially in light of the ongoing challenge to the Waqf Amendment Act 2025 and also criticised the Supreme Court's recent ruling setting timelines for the President and Governors to act on Bills.After Dubey's comments created a huge controversy, BJP National President JP Nadda said that those were not the party's views and were the personal statements of the MP and that the BJP disagreed with such statements.Case Details : VISHAL TIWARI vs. UNION OF INDIA | W.P.(C) No. 000466 / 2025
