Supreme Court Refuses To Urgently List Tamil Nadu's Suit Against Centre For Education Funds

The Supreme Court on Monday (June 9) refused to urgently list the suit filed by the Tamil Nadu government against the Centre for the release of over Rs 2291 crores under the Samagra Shiksha Scheme(SSS).A bench comprising Justice Prashant Kumar Mishra and Justice Manmohan refused to list the State's suit during the partial working days, saying that there was no urgency in the matter.Senior Advocate P Wilson mentioned the State's suit seeking urgent listing, saying that the deprivation of funds was affecting nearly 48 lakh students. He sought listing, emphasising that the new academic year started on June 3."All students, 48 lakh students, in schools in Tamil Nadu are being deprived of the Right to Education funds by the Central Government. I have to make admissions. 3rd June I have opened the new academic year.""Since when were the funds deprived?" Justice Mishra asked."Last year the funds were not given. We have filed the suit on May 20, 2025," Wilson said."No urgency," Justice Mishra said.The State of Tamil Nadu filed the original suit in the Supreme Court against the Union Government, alleging that the Centre was withholding funds under the Samagra Shiksha Scheme(SSS) over the non-implementation of the National Education Policy 2020 & PM SHRI in the State.In the suit filed under Article 131 of the Constitution, the State sought a direction to the Union Government to pay it a sum of over Rs 2291 crores, which is said to be due under the SSS, along with future interest.The State also sought a declaration that the Union's action in linking the entitlement to receive funds under the SSS to the implementation of the National Education Policy 2020 and the PM Shri Schools within the State of Tamil Nadu is "unconstitutional, illegal, unreasonable and arbitrary."Case : State of Tamil Nadu v Union of India | Diary No. 28793/2025
