Kaul: Party pramukh is the all in all- final arbiter of any dissent. People are liable to be disqualified, thrown from party. This was never disclosed to ECI.

Kaul: In that context, the ECI says that legislative votes are took.

Noone has argued that these are separate things. Political party and legislative party are connected and integral part of each other.

Kaul: It says that the constitution is dictatorial and that any form of dissent is not possible. There is no barometer available within the political party to judge what to do.

Kaul: The ECI says that even for recognition of political party, number of votes- all have to be seen to recognised political party. The ECI examines the entire structure of party and says that to get recognition, you'll abide by Constitution.

Kaul: The whole argument has been that we've treated legislative party as separate and so we can topple govt. It has never been our case that a legislature party is not an integral part of the party. 

Sibal: Within Rajya Sabha we have majority, but because of these 40, they got the symbol. That's the question before this court. What will the HC do?

Sibal: They have 40. That's how the symbol is being given to them.

Sibal: ECI says in its order that the "Test of majority in the organisational wing is not leading us to a satisfactory outcome"- I have grave objections to this.
