The Solicitor General of India said in the Supreme Court today that the Allahabad High Court's recent judgment quashing the Noida District Magistrate's order detaining a student of the Delhi University under the National Security Act in connection with the Noida workers' protest will be challenged.

While quashing the detention order, the High Court had also directed the grant of Rs 5 lakh compensation to the student, which has to be recovered from the personal salary of Noida DM Medha Roopam. The High Court had harshly criticised the DM's action in issuing the detention order, observing that her conduct is "worthy of derision", as the coercive action was passed without any application of mind.

SG Tushar Mehta said that this order was being challenged. The SG made this statement before a bench led by the Chief Justice of India during a discussion related to a show-cause notice issued by the Greater Noida Executive Magistrate against a student of the Gautam Buddha University over a campaign for the CJP protest.

This morning, after Senior Advocate Bishwajit Bhattacharyya orally mentioned the Greater Noida Executive Magistrate's action, CJI Surya Kant took a serious view of it, asking how the Magistrate could issue such an order after the Supreme Court has barred coercive actions against students for participation in the CJP protests.

Later, when the bench was about to rise for the lunch break, SG made a mention of the matter, saying that the Noida District Magistrate was getting flooded with media queries over this issue. The SG clarified that the show-cause notice was not issued by the Noida DM, but by the Greater Noida Executive Magistrate.

The CJI, in this context, referred to the Allahabad High Court's direction quashing the Noida DM's NSA detention. "That we are challenging," SG replied.
