Allahabad High Court Directs Conducting Of UPPSC Mains Exams As Scheduled, Result Subject To Outcome Of Appeal

On Friday, the Allahabad High Court stayed the Single Judge order by which UPPSC Mains Examination for various posts had been postponed till the preparation of fresh merit list of the preliminary exam.Hearing the special appeal against the order of the Single Judge on urgent mentioning, the bench of Justice Mahesh Chandra Tripathi and Justice Anish Kumar Gupta observed,“Considering the facts and circumstances and the urgency of the matter, as an interim measure, we provide that the mains examination, which is scheduled to be held on 28.09.2025, may be held as per programme and the same would definitely be subject to outcome of the instant intra-court appeal. Meanwhile, the respondents/appellant Commission is restrained to declare the result of the mains examination. Accordingly, the operative portion/paragraph '52' of the impugned judgement shall remain stayed till the next date of listing.”In para 52 of the Single Judge order, Justice Ajit Kumar had directed that the mains exam be postponed till fresh merit list is prepared for the preliminary exam. This order was challenged before the High Court on Friday in special appeal on grounds that all preparations regarding the mains examination had been made including allotment of centres, issuance of admit cards, etc. The Court observed that,“as the examination is going to be held on 28.09.2025 and since more than 7000 candidates will be appearing in the said examination, any disturbance in the examination at the eleventh hour will result in great chaos and injustice to the appearing candidates. Therefore, to maintain equity and balance of justice it will be in the interest of justice to allow the examination to be held on the scheduled date but the result will be subject to final outcome of the Special Appeal.”OBC candidates had approached the writ court against the preliminary list on grounds that those reserved category candidates who had scored more than unreserved category candidates were not placed in the unreserved category. The Single Judge, while allowing the writ petitions, directed that merit list for the preliminary examination be redrawn on the principle that if reserved category candidates have scored equal or more than unreserved category candidates, they must be placed in the unreserved category.
