Arvind Kejriwal Will Be Allotted Appropriate Residential Accommodation Within 10 Days: Centre To Delhi High Court

The Central Government on Thursday informed the Delhi High Court that Arvind Kejriwal will be allotted “appropriate” residential accommodation within 10 days, given his position as the National Convenor of the Aam Aadmi Party. The submission was made by Solicitor General Tushar Mehta before Justice Sachin Datta, who said that an appropriate order will be passed while taking on record the SG's statement. Mehta said that the issue has been resolved and that an appropriate residential accommodation will be allotted to Kejriwal “in accordance with law” as per the applicable Rules. Senior Advocate Rahul Mehra appearing for Kejriwal said that the Centre should be specific as to which type of accommodation will be allotted to Kejriwal, adding that he cannot be regulated down to what was provided to him earlier. “I will pass appropriate order. I will take note of the statement that he will be allotted accommodation within 10 days,” the Court said. The judge however added: “The practices of the Ministry have to be improved a bit. This is a recurring problem. Not only regards to the political allocations but even to non politicians as well. There is bit of an issue which needs to be replaced…”On this, Mehta said that the issue flagged by the Court will be taken seriously and will be communicated to the highest authority. The plea has been filed by the Aam Aadmi Party seeking a direction upon the Union of India (Ministry Of Housing And Urban Affairs) to allot residential accommodation to Kejriwal. Notice in the matter was issued in October last year by a coordinate bench. AAP had relied on Rule 26(iii) of an Office Memorandum issued by the Ministry of Housing and Urban Affairs on 31 July 2014. The Rule provides that a Party President of a recognized National Party can retain one residential accommodation if no other accommodation has been allotted to them in any other capacity.The party stated that all the conditions specified in the Office Memorandum are fulfilled in the case and that it has already requested the Ministry to allot residential accommodation to Kejriwal.Case title: Aam Aadmi Party vs. Union Of India Through Its Secretary, Ministry Of Housing And Urban Affairs & AnrCitation: 2025 LiveLaw (Del) 1187
