After High Court Rap, Delhi Police Assures Production Of Case Diaries By All Investigating Officers

After Delhi High Court rap, the Delhi Police has assured the Court that henceforth all the investigating officers shall produce the case diaries of the case for judicial examination. This was after Justice Girish Kathpalia, in yet another case, noted that the investigating officer had not brought the original investigation file containing Case Diaries. “Only a photocopy of investigation file has been brought. The Case Diary is of vital significance to authenticate the investigation. In the past few weeks, it is being observed that the investigating officers do not bring the case diaries,” the Court said.The APP then assured the Court that all IOs shall produce the case diaries in the cases henceforth. The Court was dealing with a plea moved by a man seeking bail in a robbery case registered for the offences under Section 309(4), 309(6), 311 and 3(5) of the Bharitiya Nyaya Sanhita and 25, 27, 54and 59 of the Arms Act.It was alleged that the vehicle used in the alleged offence by the robbers was recovered from him. Admittedly, he was not one of the three robbers.It was his case that he was innocent and had been falsely implicated in the case. It was also contended that the witnesses could not identify him in TIP proceedings.Perusing the investigation file, the Court noted that according to the seizure memo of the scooter allegedly used in the robbery, it was stated to have been recovered underneath dried plants in a park and not in the residential premises of the accused or otherwise from his exclusive possession.“Considering the above circumstances, the application is allowed and accused/applicant is directed to be released on bail subject to his furnishing personal bond in the sum of Rs. 10,000/- with one surety in the like amount to the satisfaction of the learned trial court,” the Court said. In a related development, Justice Kathpalia, in a similar order passed, granted bail to a man accused in a murder case while strongly deprecating the conduct of an investigating officer who appeared in Court without proper case file and diaries.Title: ANKIT v.
