Delhi High Court Orders Sealed Cover Disclosure Of Sunjay Kapur's Assets; Priya Kapur, Karisma Kapoor's Children Agree To Not Leak Info

Priya Kapur, wife of late industrialist Sunjay Kapur, and his former wife Karisma Kapoor's children who have filed a suit seeking a share in their father's assets submitted before the Delhi High Court on Friday (September 26) that neither they nor their counsel would make any statement in the press or leak any information regarding the case. The court was hearing an application moved by Priya Kapur in the pending lawsuit, seeking permission to file list of personal assets and liabilities of her late husband in a sealed cover with the parties to be bound by confidentiality, or in the alternative constitution of a Confidentiality Club.During the hearing the court orally said that it will not be passing an order for confidentiality club after the counsel agreed to not disclose contents of the list of assets as well information regarding the case to the media. The court further said that the list of assets can be filed in sealed cover but copies would be given to all parties. After hearing the parties, Justice Jyoti Singh while dictating the order said: "After canvasing arguments it is agreed that the list of assets of Sunjay Kapur both movable and immovable, will be filed in court in a sealed cover, copies will be shared with the parties in the lis...Mr Nayar submits that neither he nor other senior counsel, nor counsel on record nor clients (Priya Kapur) would give any press statement or leak any information concerning this case. A similar assurance has been given to the court by Mr. Jethmalani and the counsel on record as well as the plaintiffs as also Defendant 3 (Rani Kapur) and counsel on record".While hearing Rani Kapur's application seeking a direction to Priya Kapur and Defendant 4 to provide a copy of the Will to Rani Kapur, the court was told that the Original Will has been filed in court.The court then said,"The Will will be kept in possession and custody of registrar general till next date of hearing if received".It further directed that a copy of the Will will be provided to Rani Kapur, subject to the undertaking that neither counsel nor Rani Kapur will leak the document to media and will use it discreetly wherever necessary. Both these applications were disposed of. During the hearing senior advocate Mahesh Jethmalani appearing for plaintiffs questioning the need for confidentiality and submitted that in this case "confidentiality is a cloak by which you fritter away the assets"He said, "I'm highly suspicious of authenticity of this Will. I need Sunlight in this case...between 22-26 August a flurry of activity took place…assets were appropriated by the defendant to herself (Priya Kapur)...as far as shares were concerned they were appropriated by her. Few bank accounts which are in the Will have been emptied. This is conduct of person who wants confidentiality.A six percent shareholding has been appropriated to the defendant. According to this patently bogus Will I have been deprived of everything. For me there is no confidentiality".Meanwhile senior advocate Rajiv Nayar appearing for Priya Kapur submitted, "We are not supposed to have debate on assets in public domain. There is a trial by the press, everyday. I'm inviting a gag order on myself. We are concerned with the case. We are not interested in what is going on outside. Why should we not subject ourself to regulation?"On Thursday Priya Kapur moved a fresh application seeking permission to file list of personal assets and liabilities of her late husband in a sealed cover with the parties to be bound by confidentiality, or in the alternative constitution of a Confidentiality Club. The application was filed in a pending suit moved by actress Karisma Kapoor's children Samaira Kapur and Kiaan Raj Kapur against Priya Kapur her son as well as the deceased's mother Rani Kapur and Shradha Suri Marwah- purported executor of a Will dated March 21, 2025. Kapur moved the application claiming that there is a financial implication and that pleadings are being leaked to the media.During the hearing yesterday, the court orally questioned Kapur's counsel as to how list of assets can be kept in sealed cover adding that the plaintiffs being the "alleged beneficiaries to the estate have a right to question assets disclosed as in any other case" and if they have to verify the same and are bound by confidentiality club how will they defend this case. The court then orally said that it is happy to accept any suggestion which does not affect rights of any party to defend its case, pursuant to which Kapur's counsel said that she will come back with a suggestion which is holistic.
