However, a division bench comprising Justice Gita Gopi and Justice LS Pirzada permitted Asaram to communicate with his wife through video conferencing.

The Court had on Tuesday directed the local police to verify the health condition of Asaram's wife and submit a report.

The Assistant Commissioner of Police, SIT/Mahila Crime Cell, today submitted a report along with a communication from the hospital and statements of the two doctors treating her.

Appearing for Asaram, his counsel submitted that he is presently 86 years old, while his wife is 83, and that he was concerned about her health.

Opposing the plea, the Public Prosecutor referred to the doctors' statements and submitted that Asaram's wife had responded to the treatment and was presently stable. According to the doctors, she was likely to be discharged within two to three days.

The Public Prosecutor further submitted that there was no urgency warranting Asaram's release, as his wife was being treated at a multispeciality hospital and was under the care of her relatives and personal doctor.

The Court noted that the police report also stated that the wife had responded well to treatment and that both doctors had opined that she would be discharged within two to three days.

"...we do not find any reason to allow the application of applicant who is presently in jail in Rajasthan," the Court said.

However, the Court permitted Asaram to seek permission from the Jail Superintendent to communicate with his wife through video conferencing.

The present application was filed in Asaram's appeal challenging the Sessions Court judgment convicting him for rape and sentencing him to life imprisonment in a 2013 rape case. Earlier this month, the high court had rejected another application for temporary bail sought by Asaram
