The Madhya Pradesh High Court has listed the regular bail plea of retired judge Giribala Singh, an accused in the dowry death case of her daughter-in-law Twisha Sharma, for final hearing on October 26.
A bench of Justice Ajay Kumar Nirankari listed the matter for hearing at 10:30 AM.
During the hearing, the State informed the Court about a petition filed by Twisha Sharma's father before the Supreme Court seeking transfer of the proceedings from Madhya Pradesh to Delhi.
The Supreme Court has stayed the ongoing trial before a Bhopal sessions court and issued notice to the CBI, Twisha's husband Samarth Singh, as well as Giribala. Twisha's father has also filed an objection to Giribala Singh's bail application before the High Court.
The case relates to the death of Twisha Sharma, pursuant to which an FIR was initially registered under Sections 80(2) (dowry death), 85 (cruelty) and 3(5) (common intention) of the Bharatiya Nyaya Sanhita, 2023 (BNS), along with Sections 3 and 4 of the Dowry Prohibition Act.
In an earlier hearing, the High Court had directed Giribala Singh to amend her regular bail plea after she claimed that the CBI had dropped the dowry death charge against her and instead charged her with abetment of suicide under Section 108 of the BNS.
However, the State informed the Court that the dowry death charge had not been dropped by the CBI and that the offence was still under further investigation. Accordingly, the High Court permitted the inclusion of the abetment of suicide charge in the bail plea but rejected the request to remove the dowry death charge.
The investigation was subsequently transferred to the CBI following the intervention of the Supreme Court. In an earlier hearing before the High Court, the CBI had been granted time to file its reply to Singh's bail application.
Singh had earlier been granted anticipatory bail by a Bhopal trial court on May 15. The State and Twisha's parents challenged the order before the High Court, which quashed her anticipatory bail on May 27.
Singh thereafter remained in custody, with the Bhopal court extending her judicial custody on June 30 and July 14.
In her regular bail plea, Singh has claimed that the deceased was suffering from depression and that the allegations of dowry harassment were false. Her plea also refers to the absence of transactions showing that she had received money from the deceased's parents and claims that her son had instead transferred ₹7.5 lakh into the deceased's accounts
