MP High Court Directs 'Mental Check-Up' Of Advocate Who Allegedly Sent Objectionable Birthday Messages To Lady Judge

The Madhya Pradesh High Court on Friday (26th March) directed that a mental check-up of a lawyer be done, who allegedly sent objectionable birthday greetings to a Lady Judge on her official mail ID. During the course of hearing of his regular bail plea, the Bench of Justice Rohit Arya noted that the primary allegation against him was that he indulged in highly objectionable unethical activity "unbecoming of an advocate while causing embarrassment to a lady judge" through WhatsApp and on social media portals. Significantly, the Court remarked, "It appears expedient to direct for his mental checkup through a qualified Doctor or a psychiatrist and submit report before this Court." "Additional Advocate General present in the Court is directed to ensure the compliance of aforesaid direction through Superintendent of Police and other authority, if required", added the Court. The matter in brief It may be noted that the bail applicant is a practicing advocate at District Court Ratlam (M.P.) and allegation against him is that on the occasion of Lady Judge's birthday, during midnight, he sent an indecent comment on her official Government E-mail Id. Before the Court, it was also submitted that he had been harassing the lady judge in her courtroom, and on various occasions, he tried to establish contact with her by initiating useless and intimate conversation. As reported in the media, advocate Vijay Singh Yadav took a print of a cover photo from her Facebook ID and created a forged card by editing his photo, E-mail ID, address, Mob. Number etc. Further, on the forged card, he wrote a quotation in filthy language and sent that forged card to her courtroom via speed post. Subsequently, the lady judge lodged a complaint before the Station House officer, Station Road, Ratlam, and thereafter, a First Information Report for the offence under section 420, 464 468, 469 of the Indian Panel Code, 1860 and under section 67 and 41 of the Information Technology Act, 2000 was registered against Advocate Vijay Singh Yadav. The Lady Judge also made a complaint to the President, Madhya Pradesh Nyayadish Sangh in connection with the alleged activities of the Advocate.On February 13, four days after the arrest, a lower court had rejected the Advocate's bail plea, thereafter, his family had approached the Indore bench of the Madhya Pradesh High Court for bail.
