A plea has been filed before a Delhi Couet seeking registration of FIR against a young Cockroach Janta Party (CJP) protester Nishu Azad and her father.

Chief Judicial Magistrate Mridul Gupta of Patiala House Courts will be hearing the plea filed by lawyer Amita Sachdeva on September 23.

Sachdeva has filed a complaint case against the father-daughter duo over allegations that the minor posted derogatory social media posts and incited communal hatred.

The application has been filed under Section 175(3) of BNSS, 2023, seeking registration of FIR against them for the offences under Sections 196 (promoting enmity), 299 (outraging religious feelings) and 353 (public mischief) of BNS, 2023.

The incident escalated after an altercation broke out involving Swatantra Bharadwaj during which her father was allegedly assaulted and injured.

An FIR was later registered against Bharadwaj under SC/ST Act. He was granted interim bail for three weeks in the case yesterday.

It is Sachdeva's case that the impugned social media posts by Azad has insulted Hindu Deities like Bhagwan Shiv, Bhagwan Shri Krishna, Maa Saraswati, and Maa Durga.

She has contended that despite giving an opportunity to Nishu Azad for deleting the posts, the latter failed to do so, resulting in her filing an official complaint with the Delhi Police and a complaint case.

She has contended that she was left with no option but to file a complaint against Nishu Azad and guardian for alleged deliberate refusal.

In her complaint, Sachdeva has said that while disagreement with someone's faith is a personal choice, it does not confer a licence to mock, degrade or insult the Gods and worship of others.

She has said that those who post such content, and those who allow a minor's account to keep it online after notice, must be prepared to face the process of law.
