The Rajasthan High Court has directed the concerned prison authorities to provide complete medical records of self-styled Godman Asaram Bapu, life convict in a sexual assault case, to his so Narayan Sai within two days.

A Single Bench of Justice Arun Bhansali ordered thus on a writ petition filed by Sai seeking permission to administer Ayurveda treatment to his father.

His counsels, Sanjeev Punalekar and Tej Singh Gurjar informed the Bench pursuant to its order dated May 18, though the Petitioner has been supplied medical report, however, the report is incomplete and that it doesn't contain the requisite material, which can help the petitioner to seek opinion regarding condition of the prisoner and/or the treatment being administered to him.

On being inquired about the challenges for not giving all the medical papers, Public Prosecutor Gaurav Singh submitted that the State has no objection in providing the detailed report as sought by the petitioner.

Accordingly, the Single Judge has ordered,

"the requisite material i.e. complete reports pertaining to the recent illness of the prisoner, when he has been taken to different hospitals, be made available by the Dy. Superintendent of Police, Central Jail, Jodhpur only to the counsel for the petitioner Mr. Tej Singh Gurjar through e-mail, address thereof would be supplied by the counsel, within a period of two days from today."

The matter is now listed for hearing on 7 June.

Asaram got infected by COVID-19 Virus while suffering Life Imprisonment at the Central Jail, Jodhpur, and as a measure to provide treatment, he was shifted to the M.D.M. Hospital, Jodhpur, and was later on shifted to the All India Institute of Medical Sciences (AIIMS), Jodhpur.

The case pertains to a writ petition filed by Sai, alleging that the health condition of his father has been deteriorating over the past three years of judicial custody due to inappropriate and inefficient medical treatment being offered to him by the prison authorities.

He submitted that Asaram's body is accustomed to Ayurveda treatment and asserted that the prisoners also have a right to undergo treatment under such a medicinal system, as he desires or is hopeful of improving his health.

In related news, a Division Bench of the High Court has dismissed Asaram's plea for temporary suspension of sentences to pursue medical treatment. The Court also rejected the prayer to set up a medical facility at his Ashram in Pal Village, Jodhpur so as to provide him treatment, while noting that whenever he had been taken out from prison even for attending the dates of hearing during the trial, his followers would form huge congregations which would create law and order situations.

Instead, it directed the district and jail administration to ensure that Asaram is provided with proper treatment, a nutritious diet, and a safe environment looking to his old age and medical condition.
