Supreme Court Grants 3 Weeks Time To Adani Power To File Reply In GUVL's Curative Petition; Hearing On Nov 17

A 5-judge bench of the Supreme Court on Thursday granted three weeks time to Adani Power Limited to file reply to the the curative petition filed by Gujarat Urja Vikas Ltd(GUVL).The GUVL has filed the curative petition against a 3-judge bench verdict of 2019 which upheld Adani Power's termination of the Power Purchase Agreement with it.Attorney General for India KK Venugopal appeared for GUVL in the curative petition before the 5-judge bench comprising the Chief Justice of India NV Ramana, Justices UU Lalit, DY Chandrachud, BR Gavai & Surya Kant.Senior Advocate Harish Salve, appearing for Adani Power, sought three weeks time to file reply. Senior Advocate Mukul Rohatgi, also appearing for Adani Power, supported Salve's request. The bench adjourned the matter granting this request. The bench has given the GUVL two weeks time to file rejoinder after the reply has been filed by Adani.The bench has listed the matter for hearing on November 17. The CJI orally said that no adjournment will be granted on that day.In 2019, a 3-judge bench comprising Justices Arun Mishra, BR Gavai and Surya Kant had upheld Adani Power's termination of the PPA with GUVL.GUVL filed review, which got dismissed by the same 3-judge bench in September 2019. After that GUVL filed curative petition.On September 16, the Supreme Court issued notice in GUVL's curative petition against the 2019 verdict favoring Adani Power.This case had become a subject matter of controversy in 2019, after the then President of Supreme Court Bar Association, Senior Advocate Dushyant Dave, wrote a letter to the then Chief Justice of India alleging that several cases relating to Adani group were given out-of-turn listing. Dave also alleged that the cases were listed before the benches led by Justice Arun Mishra violating the then prevailing roster system.
