    The Supreme Court will hear tomorrow petitions seeking cancellation of physical examinations for Class 12  held by various state boards, CBSE compartment/private/repeater exams for Class XII, HSC and NIOS exams.

    A vacation bench comprising Justices AM Khanwilkar and Dinesh Maheshwari will be hearing the petitions tomorrow at 11 AM.

    Last week, the bench had noted "out of 28 states, 6 states have already conducted examination, 18 states have cancelled it, but 4 states (Assam, Punjab, Tripura and Andhra Pradesh) have not cancelled the examination as of now". The bench had directed the copy of the petition to be served on the standing counsels of the 4 states which are yet to cancel the board exams for Class XII.

    Also, noting that State of Kerala has not cancelled the state board exams for Class XI, the bench had directed the service of notice on the Kerala Government's counsel.

    The Bench was hearing the PIL filed by child rights activist Anubha Srivastava seeking cancellation of physical examinations. Several students have also intervened in the petition seeking cancellation.

    1152 Students seek cancellation of CBSE Class XII compartment exams

    The bench will also take up an intervention application filed by 1152 students seeking the cancellation of CBSE CLASS XII Compartment/Private/Repeaters examination.

    The plea has sought directions to the CBSE Board to arrive at a formula for performance evaluation of the Class XII private / compartment / repeaters students in line with the assessment formula adopted by CBSE and other Education Boards for the regular students and to release the results in a time bound manner.

    The intervention application has been filed in the PIL which was filed by Advocate Mamata Sharma for cancellation of physical examinations of CBSE and ICSE for Class 12.

    Objective criteria for assessment of CBSE and ICSE in place of physical exams approved

    On Thursday, the Supreme Court had accepted the objective criteria formulated by CBSE and ICSE for evaluation of students in lieue of the written exams. The bench had also asked the Boards to incorporate the provision for dispute resolution in case students want correction of final result declared, and to provide a timeline for optional exams would be declared.

    While hearing the filed by Advocate Mamta Sharma seeking cancellation of the Class 12 CBSE and ICSE written exams, a Bench of Justice AM Khanwilkar and Justice Dinesh Maheshwari observed that both CBSE and ICSE are free to notify the final scheme and inform the Court on next date of hearing.

    The Bench also refused to accept a prayer made by anintervenor that the decision of CBSE and ICSE to cancel the exam be revisited.

    While deferring the hearing to Monday, the Bench had asked the Boards to finalise the scheme in the meanwhile, and consider the suggestions given by Senior Counsel Vikas Singh, appearing for the intervenors, if any.
