Supreme Court Stays Declaration Of Results Of Trained Graduate Teachers(Special Educators) Recruitment Exam In Delhi

The Supreme Court on June 19 stayed the declaration results for the exam to recruit Trained Graduate Teachers(Special Educators) by the Delhi Subordinate Services Selection Board, set to begin from June 24.A bench comprising Justice Ujjal Bhuyan and Justice Manmohan initially stated that even though the Court will issue notice, the process must continue. "It is your case that they have not done the recruitment process for a long period of time? [But], now that they are doing it, please stall it?" Justice Manmohan asked Senior Advocate Vibha Datta Makhija, for the petitioner.Makhija submitted that as per the ongoing matter before the Supreme Court in Rajneesh Kumar Pandey & Ors v. UOI, particularly the March 7 order, States/UTs were mandated to first consider existing contractual/guest Special Educators for appointment on sanctioned posts through a screening process before initiating fresh recruitment. She further clarified that the petitioner does not seek a stay on the examination. The only concern raised is that no rights should be created for the new recruitments. After some arguments, the Court tagged it with the ongoing matter writ petition no. 132/2016 and also stayed the declaration of the results.The present petitioners have been working as special educators/guest teachers in schools under the Government of NCT Delhi on a contractual basis for teaching Children with Special Needs for several years. The petitioners were aggrieved by a notification dated May 23, July 20, 2022 and July 31, 2023, issued to conduct online recruitment exams for 945 posts.The petition is filed against the interim order dated June 10 passed by the Central Administrative Tribunal, Principal Bench, New Delhi, rejecting the reservation of 275 posts out of 945 sanctioned posts.
