J Nagarathna: if a time of offering, person of depressed class can't be present, that is exclusion. but if it is said that there should be a curtain and you can't see deity, then its areligious practice
J Sundresh: you are saying a religious practice has to be tested on whether it is secular
Khambata: it has to be tested on constitution, let say caste
J Nagarathna: article 14 doesn't enter article 25(1) space because article 14 say the state shall not exclude but article 25 is different because it talks about conscience. when there is any religious practice which excludes a class or section, article 25(2)(b) will allow state
J Kumar: in Guruvayur temple, there is so much traffic and the state regulates it and it can't be said that no no its religious practice
Khambata: it has to be a part of integral part of religion
Khambata: mylords must see if its an intergral part of the religion. I am not aware of any religion which subjugates the women or treats her as chattel.
