    The Kerala High Court on Monday (7th April) disallowed Dileep's appeal seeking CBI investigation into the Malayalam actress sexual assault case. Dileep is the 8th accused in the case and is accused of hatching the conspiracy of the crime.

    The crime took place on 18.02.2017 when a gang of assailants got into the vehicle of the victim and subjected her to sexual crimes. The crime was allegedly carried out by hired goons at the instance of Dileep, to settle his personal scores against the victim.

    His plea for CBI investigation into the case was rejected by a single judge of the High Court back in December 2018.

    While hearing Dileep's appeal on 1st April, the Court had noted he sought repeated adjournments in the appeal filed in March 2019.

    The Bench of Justice A. M. Mustaque and Justice P. Krishna Kumar today proceeded to dismiss the appeal, noting that trial before the Principal District and Sessions Court in Ernakulam is heading to completion.

    We finally concur with the learned Single Judge regard to the relief declining for further instructions to the CBI as it is now we also find that trial is heading to final conclusion”, the bench observed.

    The Bench had however eschewed certain observation of the Single Judge, saying that the matters are to be decided at the appropriate stage.

    The Single Bench had observed that it cannot be said that the publicity given by the news agencies have prejudiced the investigation. The Division Bench held that this observation was unnecessary as this cannot be ascertained until the trial is over.
