J Bagchi: when a religion practices slavery, it will be article 23 conflicting with article 26 and therefore not a state action
Gupta: now the issue is when it is not there in the constitution,.how should we apply? In puttaswamy, it was argued that privacy is being added. Court said we are interpreting the existing right.
Gupta: in kamakhya, the belief is whole hill is sacred. It happens because the whole land is sacred- golden temple or mecca. This is the kind of conflict that comes and then the essential practice test is to be applied.
Gupta: in ramjanbhoomi, after mosque was demolished, the government tried to acquire the land and it was challenged that my right to worship is violated: it was said that whether right to worship in that particular stop was essential religious pratice.
