The Allahabad High Court has observed that a Magistrate taking cognizance of an offences under the SC/ST Act before committing the case to the Special Court does not, by itself, result in the entire criminal proceedings being vitiated.
A bench of Justice Santosh Rai observed that even if the ACJM's initial exercise of jurisdiction in taking cognizance and recording statements under Sections 200 and 202 CrPC was procedurally irregular, that irregularity could not be treated as an incurable illegality which vitiates subsequent proceedings.

It held that where a statutory authority has reached its conclusion on the material before it and the substantive rights of the parties are already pending before a civil court, interference must be exercised with restraint.

A Bench of Justice Saral Srivastava and Justice Garima Prashad held that the condition was manifestly arbitrary and violative of Article 14 of the Constitution, as it makes the operation of the Scheme dependent upon a medical document which may not lawfully or practically be available

A bench of Justice Arun Kumar Singh Deshwal was apprised that the proposed guidelines prescribe 4 documents that may be accepted as proof of a child's age at the time of admission, in the absence of a birth certificate.

The case involves allegations of editing an obscene photograph/video of a minor girl and uploading it on social media.
A bench of Justice Arun Kumar Singh Deshwal passed the order while hearing a bail application filed by the accused, who is facing charges under the BNS, POCSO Act and the UP Prohibition of Unlawful Conversion of Religion Act, 2021.
UPDATES OF THE WEEK
The Allahabad High Court has sought responses from the Union Government and the Reserve Bank of India (RBI) on whether legislation or regulatory guidelines can be introduced to provide a mechanism for dependants to access money lying in the bank accounts of patients in a comatose state.
A bench of Justice Ajit Kumar and Justice Garima Prashad observed that dependants of a person in a coma become "absolutely remediless" as they may lack the necessary funds to meet hospital expenses and manage household needs.
Noting that an administrative committee cannot withhold a judicial order, the Allahabad High Court recently expressed displeasure over the delay in circulating its directions for surprise inspections of police stations to check the functioning of CCTV cameras.
"This is very unfortunate that a judicial order has been kept pending merely because a Committee could not consider the same for circulation", the Court observed.
The Allahabad High Court has issued notice to the Secretary of the Ministry of Road Transport and Highways (MoRTH) in a suo motu case concerning the deaths of 9 passengers who were charred to death in a sleeper bus fire near Jewar on the Yamuna Expressway during the intervening night of September 23 and 24, 2026.
A bench of Justice Saurabh Shyam Shamshery passed the order after considering affidavits filed by the Director General of Police and the Additional Chief Secretary (Transport), Uttar Pradesh, along with suggestions submitted by Senior Advocate Tarun Agarwal, who assisted the Court as amicus curiae.
The Allahabad High Court (Lucknow Bench) has sought clarification from the Bar Council of Uttar Pradesh on whether an advocate's Certificate and Place of Practice (COP) can be reissued to reflect a change in the place of practice.
A bench of Justice Rajan Roy and Justice Manjive Shukla asked whether such reissuance of CoP is permissible and, if so, whether any time limit is prescribed for it.
The Allahabad High Court has directed the Municipal Commissioners of Lucknow and Prayagraj to identify dog-bite hotspots in their areas/cities and undertake the exercise of humane capture and removal of dogs from such areas.
The civic authorities have been asked to give priority to dogs found on verification to have repeatedly attacked persons or shown aggressive behaviour, particularly where several complaints have been received.

The Court described the conduct of the authorities, especially that of the District Magistrate, Ayodhya, as "highly condemnable".
The Allahabad High Court has observed that lack of resources, space or infrastructure is no answer to a general mandamus issued by the Supreme Court requiring installation of CCTV cameras and preservation of footage for the specified period of time in police stations.
The Court sought an affidavit from the Senior Superintendent of Police (SSP), Ayodhya, explaining why the CCTV footage of the lockup at Cantt Police Station was not preserved and provided to an applicant who sought it under the Right to Information (RTI) Act.
